In no event shall Myholidaybeat S.L. and/or its suppliers be liable for any, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of services or material or with the delay or inability to use this the aforementioned, or for any information, accommodation, products, and services obtained through publications, or otherwise arising out of the use of these web sites, whether based on contract, tort, strict liability or otherwise, even if Myholidaybeat S.L. or any of its suppliers has been advised of the possibility of damages.

If, notwithstanding the foregoing, Myholidaybeat S.L. or any third-party data provider or accommodation provider should be found liable for any loss or damage which arises out of or is in any way connected with any of the above-described functions or user publications, services or its contents.  Myholidaybeat S.L. and third-party data provider’s and accommodation provider liability shall in no event exceed, in the aggregate, the subscription fee or service charge/booking fee for accessing this site with respect to which liability is found and in no event will the providers be liable for loss of profits, opportunity, revenue or profit by the customer and/or indirect or consequential loss whatsoever.

The customer shall indemnify and hold harmless the providers against all third party actions or claims and costs arising from any act or omission pursuant to the agreement. The provider shall be released from its obligations under this agreement where it fails to meet its obligations on account of an act of god, ware, attacks fire, flood or subsidence, equipment failure, power failure, work stoppage or other industrial action by the provider or any third party, which is either directly or indirectly, beyond the provider’s control. Myholidaybeat S.L. is not a party to the agreement and acts as booking system operator only and in principal shall have no responsibility in respect of the terms hereof, whether directly or indirectly.

Customers are responsible to follow the instructions given by Oceanbeat (Myholidaybeat S.L.) regarding place, time and safety. If they don’t follow the instructions there is no right for any refund. With the purchase of a ticket the customer agrees with the commercial use of photos, video material, etc. which are taken during the events of Myholidaybeat S.l.

Tickets purchased are for the purchaser’s and/or the group’s personal use. They may not be resold and are non- transferable.

You must be a minimum of 18 years of age to attend any clubbing venues, boat parties or other clubbing-related events.

Multiple bookings. In the case of multiple bookings, the credit card holder is required to present him/herself at the venue. Entry will be refused unless the holder of the credit card used for payment of the tickets is in attendance.

The credit cardholder shall be required to present the credit card used for payment, along with an identity document with a photograph (driving license, national ID document or passport) at the entrance to the venue. Photocopies will not be accepted. (If payment has been made via PayPal or the tickets are part of a package deal presentation of a credit card will not be necessary). Nearly all venues require clients to show a printed entrance ticket, this is stated clearly in your confirmation e-mail.

In the event that the venue is not open on the date for which the ticket was purchased, or if the event is canceled, you will be advised of this fact in advance by e-mail and reimbursed for the full amount paid.

The venue reserves the right to refuse admission under specific circumstances, which include evidence of consumption of alcohol, drugs or other narcotic substances. In the event of refusing entry to the venue, Myholidaybeat S.L.cannot accepts any liability in this regard and any appropriate claims should be made to the proprietors of the activity.

In the event of theft or loss of the tickets purchased, contact Myholidaybeat S.L. by e-mail as soon as possible in order to obtain replacements.

The list of DJs advertised may be subject to changes. Myholidaybeat S.L. cannot be held responsible for any changes made in this regard.

In the event that the card used to purchase the ticket is stolen or tickets are purchased through fraudulent use of the card, the amount can be reclaimed by contacting Myholidaybeat S.L. at least 24 hours prior to the event. In this case, the tickets purchased will be canceled.

Customers are responsible to follow the instructions given by Oceanbeat (Myholidaybeat S.L.) regarding place, time and safety.

With the purchase of the ticket, THE client agrees to the environmental protection program of Myholidaybeat S.L. The client has to take care of their plastic cups. If the cup gets lost, the client will have to buy a new one for 1 €.

Myholidaybeat S.L. is only the operator of the boat party. For this event, Myholidaybeat S.L. only has got a limited liability, since Myholidaybeat S.L. is not equipped with own event localities. The boat party takes place on a hired boat of the company Ulises Cat. The company Ulises Cat is responsible for adherence to safety standards on the boat. Furthermore, Myholidaybeat S.L. assigns the security company Control Solutions Ibiza S.L., which is in charge of the security of our customers on the boat. For all other events including the pre-party, after-party and club events, Myholidaybeat S.L. acts in this transaction merely as an agent for the venue, selling tickets for access thereto, thus any liability is strictly confined to the venue to which the client buys a ticket and the company will not accept any liability for activities taking place at the venue. All events offered to the clients are based on availability, thus places and dates can change.

​In case of breach of fundamental treaty obligations (so-called cardinal obligations), which are based on ordinary negligence, the operator has limited liability for the substitute for typical, predictable contractual damages.

Ulises Cat and the safety company have got unlimited liability for intentional and grossly negligent damages, in the event of malicious non-disclosure of a defect as well as for damages resulting from the destruction of life, physical injury or damage to health.​

The operator is not liable for damages caused by simple negligence, except in the cases described in point (B) and (C)

 

Implementation, adjournment or event cancellation/ Return and refund of the event ticket.

In the event of customers´ cancellation, Myholidaybeat S.L reserves the right to retain cancellation fees equal to the reservation cost (pre-payment).

Myholidaybeat S.L. reserves the right to reschedule the boat party to another time within 24 hours with no refund. Event tickets will only be refunded, in the case of an event cancellation with no alternative event. The purchase price will be refunded, but not the advance booking fee, the shipping costs or any other fees.  Costs of travel will not be refunded. Therefore, visitors will have to inform themselves in due time, if the event takes place.

The organizer reserves the right to change the time and/or venue of the event. The event tickets retain thereby, their validity.The event will take place regardless of the weather conditions, unless our captain predicts a significant risk to the life, health, safety or comfort of our customers, artists and staff.
Therefore significant limitations may arise. If the event is cancelled, it will be done so under the arrangement of the owner of the localities of the event. Whether and to what extent a refund may be given depends on the timing of the cancellation of the event and what services were provided up to that point. The above provisions apply by analogy to other necessary event cancellations e.g. administration, technical issues. Due to weather, wind, strong currents, heavy port traffic and other factors at sea, the departure time may be delayed by up to 2 hours. It is not possible to request a refund for these factors.
We ask that customers leave a buffer of time around their scheduled boat party, when planning their other activities.

CORONA VIRUS UPDATE

Due to possible upcoming governmental market regulations, we might not be able to run our boat party events as planned. In this case, we reserve the right to offer an alternative boat tour within 48 hours, before or after the originally planned event. Once, we offer an alternative event within the time of 48 hours, the entitlement for a full refund is not valid. The check-in location may vary from Playa den Bossa to San Antonio, Ibiza.
